Welcome to Tofromtags, a platform that bridges the physical and digital worlds of gift-giving through QR code tags. Please read these Terms of Service ("Terms") carefully before using our services.

By using Tofromtags ("Service", "Platform", "we", "us"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Tofromtags. By using the Service, you represent and warrant that you meet this requirement.

2. Description of Service

Tofromtags allows users to:

Purchase QR code tags through our online shop.
Activate tags via unique activation codes.
Upload personalized content (text, images, video).
Share tags with gift recipients who can view and reply without creating accounts.

No user registration is required for gift givers or recipients. Ownership is maintained through device-based cryptographic tokens.

3. Acceptable Use

You agree not to:

Upload or share content that is obscene, harassing, illegal, harmful, or infringes on third-party rights.
Attempt to reverse-engineer or tamper with any part of the platform.
Use the system to spam or send unsolicited messages.

We reserve the right to remove or restrict access to any content or user if these rules are violated.

4. Content & Moderation

All user-generated content must comply with our Community Standards. Tofromtags implements:

Content validation and moderation (automated or manual).
Video length limits and file size restrictions.
Expiration of content after a defined period.

We are not liable for user-submitted content but reserve the right to remove content at our discretion.

5. Ownership & License

You retain ownership of the content you upload. By submitting content, you grant Tofromtags a non-exclusive, worldwide, royalty-free license to host, display, and transmit your content for the purposes of operating and improving the service.

6. Payments & Refunds

All payments are processed securely via Stripe. By purchasing, you agree to Stripe's terms and our refund policy. Refunds may be issued for:

Duplicate orders
Non-functioning tags (after verification)
Technical issues preventing use

Contact support with your order ID to initiate a refund request.

7. Privacy

We are committed to protecting your privacy:

No accounts or personal data are required to view or reply to messages.
All content is stored securely and expires automatically.
Payments are handled via PCI-compliant third-party providers (Stripe).
No tracking of gift recipients or analytics on personal conversations.

8. Intellectual Property

All platform software, branding, and materials (excluding user-submitted content) are the intellectual property of Tofromtags. You may not reuse or redistribute these assets without permission.

9. Limitation of Liability

Tofromtags provides the service "as is." We are not liable for:

Damages resulting from the use or inability to use the service
Data loss due to expired content
Indirect, incidental, or consequential damages

In no event shall our total liability exceed the amount paid for the tags.

10. Indemnification

You agree to indemnify and hold harmless Tofromtags and its affiliates from any claims, liabilities, damages, and expenses arising from your use of the platform or violation of these Terms.

11. Changes to the Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via our website. Continued use of the Service constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes will be resolved in the courts located in the United States.
